Newport Systems provides custom
web-based equipment and repair management solutions for the transportation and intermodal industry (“Technology Solutions”).  This Privacy Policy (“Policy”) defines how Newport Systems collects, uses, and stores personal information it obtains from users of Newport Systems’ Services.  The Policy applies to all personal information received by Newport Systems in the United States from users of the Newport Systems website (
www.NewportSystemsUsa.com) (“Site”), mobile application (Newport DMS), and all customer managed sites (Newport WES and Newport DMS).  Customer managed sites are web applications that Newport Systems manages for customers for equipment and repair management solutions. The users include clients of Newport Systems (“Newport Systems Equipment Owners and Vendors”), customers of Newport Systems Equipment Owners using Newport Systems (“Newport Systems Equipment Owner Vendors”), and  anonymous visitors (“visitors”).

By using the Site, Mobile, and other applications (as a Newport Systems Equipment Owners, Vendors and visitors), you are agreeing to the terms of this Privacy Policy and, as applicable, the Newport Systems Terms and ConditionsThis Privacy Policy will be updated from time-to-time to address changes to our privacy practices or for other operational, legal, or regulatory reasons. If we make material changes to this Privacy Policy, we will give you notice of such changes by posting the revised policy on the Site and, where appropriate, by other means as well. By continuing to use this Site after changes are posted, you agree to the revised policy.


2.  Information Collection

The following information may be collected by Newport Systems Vendors and Equipment Owners using the Website and Customer Managed Sites:

Newport Systems customer employee name, company name, company address, email address of client employees who administer the site or use the site to manage process on behalf of others. This information is used to provide access to
site functions and to communicate transactions performed on the site. 

Newport Systems Customer name, company name, company address, email, shipping and billing address. This information is used by Newport Systems to provide services, including supporting and processing estimates/work orders, reefer monitoring, and gate operations.

Browsing information from all Newport Systems-hosted webpages and mobile applications. The information may include account access patterns, including information about the device and browser, user location, network connections and your IP address.  This information is collected to provide analytics that enable Newport Systems to improve their services and business operations.

Personal information, including name, company name, company address, email address, provided during inquiries about Newport Systems business and services from Newport Systems websites.  This information is provided directly by
you and is utilized solely for the purpose of responding to your request.

Information Collection Processes

Newport Systems does not collect Personal Information when Newport Systems Vendors and Newport Systems Equipment Owners Customers register to use Newport Systems Technology Solutions operated on behalf of the Newport Systems customer.

Browsing and account information is collected during use of Newport Systems Sites.  Account information are user login credentials, email, and permissions required to perform work related to equipment and intermodal operations.  No personal information nor financial information are collected to operate the sites.

3.  Choice Control and Access to Personal Information

Users of Newport Systems through the Site retain all rights to their Personal Information and can access it at anytime. 4.  Use of Cookies and Other Tracking Technologies

A cookie is a small amount of data, which may include a unique identifier. Cookies are sent to browsers from websites and stored on the browsing device. Newport Systems technology solutions assign a different cookie to each device that accesses our website.

Purpose

Cookies are used to recognize the device and provide a personalized experience to users of the Newport Systems Site. The purpose of the cookie is to identify preferences for use of the Newport Systems Technology Solutions.  Cookies are stored on the browsing device to assist in providing and improving our Newport Systems Services the services provided to Newport Systems Equipment Owners and Vendors. For example, cookies are used to maintain browsing session. Data collection devices such as Google Analytics help analyze web page flow, measure promotional effectiveness, and to provide information relevant to browsing parties’ interests. Google Analytics helps website owners understand how
visitors engage with their website. We can view a variety of reports about how visitors interact with our Site so we can improve it. Google Analytics collects information anonymously, and uses cookies, and IP addresses, and reports website trends without identifying individual visitors.

5.  Use of the Site by Children

You must be 18 years of age to use the Site.  Newport Systems does not knowingly collect or maintain information from children under the age of 13, and no part of the Site is designed with the intention of attracting such children.

6.  Links to Other Websites and Services

The Site may contain links to other websites that are not controlled and/or maintained by Newport Systems.  Please be aware that those other websites may have different privacy policies which may subject you to different privacy practices.  Please review the privacy policies of such other websites for information concerning what information is collected on such websites and how it is used.  Newport Systems is not responsible for the contents or privacy practices of any linked site or any link on a linked site.

7.  Third Parties

Newport Systems works with third parties to provide supporting functions to their Technology Solutions and Site.   During the course of providing the additional functions Newport Systems may share Personal Information with them to support these efforts.  Service Providers are contractually bound not to use Personal Identifiable Information other than in connection with providing services to Newport or as permitted in this Policy or as otherwise permitted by law.

In certain limited circumstances, Newport Systems may be required to share information with third parties to conform to legal requirements or to respond to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Personal Information may be shared with third parties to prevent, investigate, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service or any other agreement related to the Services, the Site, or as otherwise required by law.

Personal Information may also be shared with a company that acquires our business, whether through merger,  acquisition, bankruptcy, dissolution, reorganization, or other similar transaction or proceeding. If this happens, we will post a notice on our home page.

Newport Systems is subject to the regulatory enforcement powers of the U.S. FTC. In certain situations, we may be required to disclose personal information in response to lawful requests by public authorities, including to meet national
security or law enforcement requirements.

Newport Systems remains responsible for Personal Information that is transferred to a third party for processing or to support our efforts in providing its Services. Any Personal Information transferred to a third party for data processing is processed in accordance with our instructions, and is subject, by law, to a comparable level of protection as that provided by Newport Systems.

A “comparable level of protection” means a level of protection generally equivalent to that provided by Newport Systems.  For purposes of this policy, Newport Systems contracted parties are Microsoft Azure, iLand Technologies, and Softacom Technologies.

8.  Termination of Services

Newport Systems will continue to store archived copies of collected personal information for legitimate business purposes and to comply with the law.    We will only keep your personal information for as long as it is necessary for the
purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting and other legal requirements).   When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it.  In addition, Newport Systems will continue to store anonymous information, such as website visits, without identifiers, to improve its Services.  Unless you request deletion of your  personal information, we may retain it for seven (7) years from the last date after receipt of such Personal Information

9.  Restrictions

Newport Systems will never share, disclose, sell, rent, or otherwise provide Personal Information to other companies for the marketing of their own products or services.

Newport Systems does not use the Personal Information we collect from Newport Systems Equipment Owners,  Vendors,  or Anonymous Visitors to independently contact or market its Technology Solutions.

10.  Information Protection

Newport Systems abides by industry standards on information security management to safeguard sensitive information, such as financial information, intellectual property, employee details and any other Personal Information entrusted to
us.  Its information security systems apply to people, processes and information technology systems on a risk  management basis.

Data center hosting providers used to host Newport Systems Services are ISO270001 certified.

Technology development partners comply with industry standards for the development of secure websites.

Newport Systems services are provided via Secure Socket Layer transmission. Further, we follow generally accepted industry standards to protect the information submitted to us, both during transmission and once we receive it. That said, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

11.  Cross Border Information Protection

While Newport Systems is a United States company, we provide services to customers and our technology processes data from users around the world.   Our servers are located in the United States.  If you are accessing our Sites from outside the United States, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information with.  Accordingly, Newport
Systems may transmit your personal information outside of the country, state, or province in which you are located.
